Prosecution and defense of litigation in bankruptcy court is one of our biggest strengths. We have represented clients in all manner of contested matters and adversary proceedings including fraudulent conveyances, preferences, relief from stay motions, nondischargeability actions, trustee motions, and the entire range of litigation matters which arise in bankruptcy cases.
Fraudulent Transfers and Preferences
We have prosecuted and defended hundreds of fraudulent transfer actions involving leveraged buyouts and other questioned transactions across all fields of bankruptcy experience. We have also prosecuted and defended hundreds of preference actions, including representation of numerous major international corporations, including Sprint PCS, Cosco, Frito-Lay, Simmons Company, Budget Car Rental, Capital Factors, Hyatt, and Invicta Watch.
Trustee Motions
The firm has litigated hotly contested disputes on both sides of trustee motions: defending against the appointment of trustees to displace existing management in chapter 11 cases, and seeking the appointment of trustees based on fraud, mismanagement and similar grounds.
Relief from Stay Motions
Relief from stay proceedings frequently involve litigation over real estate, valuation and reorganization issues. As the moving party, the firm has successfully advanced relief from stay litigation on behalf of nationally recognized lenders.
In conjunction with our debtor practice, we also have broad-based expertise in the defense of relief from stay litigation.
Dischargeability Cases
The firm has defended and prosecuted many nondischargeability cases, which are akin to civil fraud actions and often present complicated issues of proof.
